Official Rules

THESE OFFICIAL RULES GOVERN ANY SWEEPSTAKES CONDUCTED BY AN INDIVIDUAL BLOGGER (A “PARTICIPATING BLOGGER”) WHO IS AUTHORIZED TO AWARD A WINDOWS PHONE PROVIDED BY MICROSOFT CORPORATION (“PRIZE SUPPLIER”). THE DATES AND PRIZE DETAILS OF EACH PARTICIPATING BLOGGER’S SWEEPSTAKES WILL BE DETERMINED BY THE PARTICIPATING BLOGGER AND CAN BE FOUND ON A PARTICIPATING BLOGGER’S WEBSITE. PARTICIPATING BLOGGERS ARE RESPONSIBLE FOR THEIR OWN SWEEPSTAKES ADMINISTRATION, INCLUDING, BUT NOT LIMITED TO, PRIZE DETAILS, WINNER SELECTION, WINNER NOTIFICATION, AND AWARDING OF PRIZE. THESE OFFICIAL RULES SHALL BE INCORPORATED INTO ANY RULES POSTED ON THE PARTICIPATING BLOGGER’S WEB SITE. THE SWEEPSTAKES IS GOVERNED EXCLUSIVELY BY THE LAWS OF THE UNITED STATES.

1. ELIGIBILITY: Sweepstakes is open only to residents of the fifty (50) United States and District of Columbia, 18 years of age or older at the time of entry. Void in Puerto Rico and where prohibited by law. Employees, officers and directors of Participating Blogger, and its parent, affiliate, and subsidiary companies, as well as all others involved in this Sweepstakes and their immediate families (defined for the purposes of this Sweepstakes as parents, spouses, children, siblings and household members) are not eligible. Any entry that does not meet the eligibility requirements, in the Sponsor’s sole discretion, will be disqualified. Sweepstakes is subject to all federal, state, and local laws and regulations.

2. PRIZE DRAWING: Prize(s) will be awarded at the conclusion of the Sweepstakes in a random drawing from all eligible entries received. One prize will be awarded by each Participating Blogger. The odds of winning depend on the number of eligible entries received by each Participating Blogger throughout the entire Sweepstakes. See “Dates of the Giveaway” and “Giveaway Prizing” on the participating Blogger’s Web Site for the applicable Sweepstakes dates and prizing details. Applicable Sweepstakes dates and prizing details may vary based on the Participating Blogger’s Web Site, as determined by the Participating Blogger. By entering the Sweepstakes, entrants unconditionally agree to these rules. Judges decisions are final and binding on entrants. The limit on the number of entries will be determined by the Participating Blogger.

3. PRIZE(S): Each winner will receive a Windows’ Phone. Limit one (1) entry and one (1) Prize per person. The number of Prize(s) given away during the Sweepstakes Period will be disclosed on Participating Blogger’s Web Site. Prize(s) consist(s) only of items specifically listed as part of the prize. Prizes are nontransferable and no substitution or cash equivalent is allowed, except in Sponsor’s sole discretion. Sponsor reserves the right to substitute prize of the same approximate retail value. All taxes, costs and expenses not specified herein related to the prize(s) are the sole responsibility of the Winner.

4. WINNERS: Each of the potential winner(s) will be notified by email approximately five (5) days after winner selection, and each potential winner must provide their shipping address to receive the Prize. Please allow up to four (4) weeks to receive the Prize. If a potential winner cannot be contacted, if prize or prize notification is returned as undeliverable, if winner rejects his/her prize or fails to comply with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. Except where prohibited, acceptance of prize by any winner constitutes winner’s consent that their names, likenesses, voices, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.

5. ADDITIONAL TERMS: This Sweepstakes is for viewing in the United States only. If you do not live in one of the 50 United States or the District of Columbia, do not enter the Sweepstakes. If for any reason the Sweepstakes including, but not limited to, the online portion, does not function as planned, its integrity or feasibility is undermined, or anything compromises the administration, security, fairness, proper conduct or intended play of the Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual the Sponsor deems responsible. Sponsor assumes no responsibility for any defect or delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. All entries are the property of the Sponsor and are not returnable. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sweepstakes entries generated by a script, macro, or other automated means are ineligible and will be disqualified. In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry. Sponsor reserves the right to disqualify entries that in its sole discretion include inappropriate, obscene or offensive comments or material.

6. RELEASE OF LIABILITY: By entering, entrant agrees to accept and abide by the rules of this Sweepstakes and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation, or award of prize, shall be resolved by Sponsor in its sole discretion, whose decision shall be binding and final. By participating, entrant agrees to release and hold harmless Sponsor, Prize Supplier, Mr Youth, LLC and their respective parent companies, affiliates, subsidiaries, and the officers, directors, employees, agents and representatives of each from any injury, loss or damage to person or property due in whole or in part, directly or indirectly to the acceptance, use, or misuse of a prize, participation in any Sweepstakes-related activity, or participation in the Sweepstakes. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Sweepstakes or in the announcement of prizes, including such error as may give an erroneous indication that a prize has been won.

7. DISPUTES; GOVERNING LAW: The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, City of New York.

THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of New York in the State of New York. The parties agree not to raise the defense of forum non conveniens.

8. LIST OF WINNERS’/WINNER’S NAMES. For the name(s) of winner(s), send a self-addressed, stamped envelope to the Participating Blogger no later than four weeks after the Sweepstakes end date.

SPONSOR: Each Participating Blogger is the Sponsor of his/her respective promotion and no other promotion. The following list contains the names/address of each Participating Blogger/Sponsor.
